The U.S. Department of Labor’s final-pay guidance explains that federal law does not require an immediate final paycheck and directs an unpaid worker to seek help if the regular payday for the last pay period has passed.

That federal position is a baseline, not a rule that overrides an earlier state deadline. Under California’s final-wage FAQ, a discharged employee generally must receive all wages due, including accrued vacation, immediately; an employee without a definite-term written contract who gives at least 72 hours’ notice and quits as scheduled generally must be paid at quitting, while payment is generally due within 72 hours when that notice is not given.

Texas follows a different timetable. The Texas Workforce Commission’s final-pay guidance sets a deadline of six calendar days after an involuntary separation and the next regularly scheduled payday after a voluntary separation; it also explains that a separate schedule in a wage agreement or policy may govern commissions, bonuses or other pay components.

Use the place of work as the jurisdictional starting point

Begin with the state where you physically performed the work, rather than automatically choosing the employer’s headquarters, payroll provider or state of incorporation.
